Within 48 hours of taking possession, the vehicle suffered a blown head gasket, a catastrophic mechanical failure that constitutes a pre-existing latent defect—a serious condition that existed prior to the sale but was not disclosed to me. This defect renders the vehicle unsafe, inoperable, and unfit for its intended use. Claims that I did not purchase the optional 2-day cooling-off period or that the vehicle is covered under a manufacturer warranty are legally irrelevant. Under California Civil Code §§ 1791.1 & 1792 (Implied Warranty of Merchantability), a dealer is obligated to sell a vehicle that: 1.Is safe and operable at the time of sale 2.Is fit for ordinary driving purposes 3.Does not contain major latent defects that make the vehicle unsafe, inoperable, or unusable immediately after purchase The presence of a pre-existing latent defect is a direct violation of these provisions. The manufacturer warranty does not excuse the sale of a vehicle with a defect that existed at the time of purchase. I am therefore demanding, without delay: 1.Immediate rescission of the sales contract by Raceway Nissan 2.Full refund of all funds paid, including deposits and trade-in credits 3.Coordination with Valley Strong Credit Union to fully rewind the auto loan, including principal, interest, fees, and any other charges 4.Confirmation that I will have no financial obligations related to this purchase once the rescission is completed
My car started shaking like it didn’t want to go. My engine light came on. Then it showed road departure mitigation system problem, collision mitigation system problem, adaptive. Those control problem, and emissions system problem then says engine is not functioning properly.

This means we did not drive much. We are both above [XXX] and [XXX]. This car was purchased from your dealer Gillman Honda dealer we specifically asked the salesperson that is this car is in recall or Also in the trunk of car we received vehicle use agreement indicating car was allowed to use to other customer named [XXX] with address of customer and other details. We can provide the paper as and when required by you. We paid $10000.00(Ten thousand cash) on [XXX] and later since date of purchase paid $298.97 instalment to Honda Financial services regulator regularly without any interruption. Per recall notice the reason is very scary as this vehicle is defective and burn on road due to your manufacturing defect. Because of our [XXX], if such an incident happened it is difficult for us being [XXX] person to get out from car and survive. My wife is [XXX], and she is unable to drive this car as it is rickey. We therefore request you to please take your car back and refund our full money back. We trust that Honda company will defiantly help in this situation and refund payment or replace 2025 model (if not defective and no on recall list ) with sane facility and upgrade model whatever we have. The contact received notification of NHTSA Campaign Number: 24V763000 (Fuel System, Gasoline); however, the part to do the recall repair was not yet available. The local dealer was contacted. The contact called other local dealers: Spreen Honda Loma Linda (25050 Redlands Blvd, Loma Linda, CA 92354), Capital City Honda (3630 Fulton Ave, Sacramento, CA 95821: and Walnut Creek Honda Service (1707 N. Main St., 1699 Locust St., Walnut Creek, CA 94596), but the vehicle was not diagnosed or repaired. The contact stated that the manufacturer had exceeded a reasonable amount of time for the recall repair. The manufacturer was made aware of the issue. The manufacturer opened a case. The failure mileage was approximately 8,000. VIN tool confirms parts not available.
