The contact stated that while driving approximately 55 MPH with the adaptive cruise control activated, the vehicle nearly crashed into the rear of a second vehicle. The contact stated that the adaptive cruise control did not operate as needed to decelerate or stop the vehicle. The cause of the failure was not yet determined. The manufacturer and local dealer were notified and indicated that a software update of the adaptive cruise control was needed. The vehicle was not yet repaired. The failure mileage was 93,000. The contact stated it was an operator error as he depressed the CC button as opposed to the ACC button and wishes to rescind the complaint.
